Darby Township commissioner charged with rape from 2017

PHILADELPHIA (KYW Newsradio) — Philadelphia police say a Darby Township commissioner sexually assaulted a juvenile in his car more than four years ago.

Marvin Smith, 50, has been charged with rape, statutory sexual assault and related offenses.

Police say the assault took place on Aug. 12, 2017. The victim reported it to authorities in April 2019.

The victim told police that Smith approached him in his car. He said he was a family friend and offered to give him a ride home. Smith drove them to a park in Cobbs Creek and exposed himself to the victim, police say, then sexually assaulted him.

Authorities did not specify the age of the victim at the time of the alleged assault.

Police issued an arrest warrant for Smith in November. He turned himself in on Tuesday.

Smith is listed online as a Darby Township commissioner for the 1st Ward.

Marvin Smith pleaded no contest to a single charge of corruption of minors and was sentenced to one year of probation by Judge Charles Ehrlich. He was ordered to stay away from the victims and to attend a life skills training course.
