PHILADELPHIA (KYW Newsradio) — The Delaware County District Attorney’s Office further confirmed Monday that the eight-year-old who was shot and killed outside an Academy Park High School football game last month was likely hit by police gunfire.
The office is also empaneling a grand jury to further investigate.
District Attorney Jack Stollsteimer said a ballistics analysis shows with near certainty that Fanta Bility and three others were hit by gunfire from Sharon Hill police officers on August 27.
Stollsteimer said as fans were leaving the game, there were several gunshots about a block west of the stadium entrance.
He said that at about the same time, a car turned on the street directly in front of police officers standing at the stadium entrance. Stollsteimer said it appears that's what prompted the police officers to open fire.
Stollsteimer said his office is still investigating whether the use of deadly force by the officers was legal. The three officers who opened fire are on desk duty pending the results of the investigation.
He added the county is empaneling a grand jury to investigate the shooting. Sharon Hill Borough has hired outside counsel to review their use-of-force policies.
