
Richmond, Va. (Newsradiowrva.com) -- Seven school districts, including Richmond, have filed a lawsuit over Governor Glenn Youngkin's Executive Order on masks. The lawsuit is the second filed, as a group of parents from Chesapeake is also challenging the order in front of the State Supreme Court.
The order, which went into effect Monday, creates a mask opt-out for parents. However, most local districts have chosen to keep their mask rules for the time being. Richmond, however, is the only local district suing. The suit, which also includes Fairfax and Hampton, asks the court if the Governor can override a school board's constitutional power with an executive order, and whether such an order can also override state law. The districts believe the state law that mandates five-day a week school also mandates masks.
The Chesapeake suit could be heard by the Supreme Court of Virginia this week.
