Richmond, Va. (Newsradiowrva.com) - The Supreme Court of Virginia has dismissed a lawsuit brought by Chesapeake parents against Governor Glenn Youngkin's (R) mask opt-out executive order. The dismissal was mostly along procedural lines.
While the dismissal order was predominately procedural, the Court did seem to suggest that school boards have a lot of discretion in dealing with Covid, and that extends to masks. The Court went out of its way to state that it did not rule on the legality of the executive order. An Arlington judge last week did rule that the executive order took powers given to school boards, and issued a temporary restraining order on EO2.
There remains two other lawsuits on the mask issue, one in federal court, and another, which is pro-mask options, in Loudoun Circuit Court. The Governor has vowed to appeal the Arlington ruling.
