There is little doubt that simply by following the news of the Washington Commanders over the last few years – from lawsuits both by and against the owner to Congressional hearings – fans have an above-average understanding of the law.
However, there are new areas of the law still to cover and so legal analyst Dan Lust joined The Hoffman Show Tuesday to talk about a reported provision in the pending sale agreement between the Josh Harris-led group that would legally indemnify owner Dan Snyder from any future liability in claims that may. come up down the road.
According to a report in The Athletic, the language in the agreement would partly indemnify Snyder "for future litigation stemming from the many pending investigations into his tenure."
The indemnification agreement would be between Snyder and the Harris-led group, not the NFL, which could be another issue. And, of course, this could be holding up the sale process.
"Red flags are always up with this Washington situation," Lust told Hoffman. "I'm confident at this point that the team will be sold... I'm not ready to say at this point that it's gonna be Josh Harris.
"Again, that's the whole point of a non-exclusive agreement. That's the whole point of why you're seeing these whispers about the indemnification clause, why the [Brain Davis $7 billion bid appears]."
