
JOLIET (WBBM NEWSRADIO) -- There’s been a major setback for a grassroots group that has challenged the building of the Northpoint warehouse park in Joliet.
Stop Northpoint claims the amount of truck traffic that would be generated by the Northpoint development would create a nuisance. But, according to the Joliet Herald, Will County Judge Ted Jarz ruled that no cases have been found where the idea of increased truck traffic has been recognized as a prospective public nuisance, and so he threw out Stop Northpoint’s lawsuit.
“Research has failed to reveal any Illinois case identifying a public right to be free from increased truck and vehicle traffic above existing levels, or the consequences of increased traffic, that has been recognized as a prospective public nuisance,” Jarz wrote in a 19-page ruling.
But, he did open up the possibility the group may have an argument down the line.
An attorney for Stop Northpoint said the group is looking at its options. Stop Northpoint said lawyers would consider an appeal, but no decision has been made yet.
NorthPoint issued a statement saying the ruling “sends a loud and clear message that Compass [Global Logistics Hub] is committed to designing a responsible, community-focused plan that balances safety, controls truck traffic and maintains quality of life.”
