GARY, Ind. (WBBM NEWSRADIO) -- The girlfriend of a 25-year-old Gary man who was shot to death by a police officer early last Saturday morning has hired a lawyer and is describing what she says she was told occurred.
"There's two witnesses that have the exact same story, that my boyfriend was shot in cold blood. He was talking to the officer when he died, that he's allowed to be outside his home," said Heather Fox outside the home she and Rashad Cunningham shared with five kids, 1 to 8 years old. "He was just trying to go in the house. He didn't think he was going to die that night by the police, someone who's supposed to protect and serve us. They ripped them witnesses out the car and stepped on their heads and told them they should have shot them too."
Cunningham had a gun in his lap, as he sat in the passenger side of the vehicle with two friends in the car. He had a concealed carry permit.
Fox said Cunningham told the officers that he had a right to be there; and that the officer who shot him is known for harassing people.
She said five or six shots were fired and, she said she heard that four struck Cunningham.
Cunnigham is expected to file a wrongful death lawsuit against the police department.
