
(WBBM NEWSRADIO) - A McHenry County jury has awarded over $9 million to a Lake Hike in the Hills man, finding ComEd responsible for his 2016 bicycle accident.
Attorneys proved that in November of 2016 the utility company, while completing a utility pole project, damaged the asphalt bike path near Miller and Lakewood roads and caused rider Andrew Farley to be thrown head first off his bike.
Farley’s lawyers claimed he was unaware of the ComEd work near the path. Farley suffered a mild traumatic brain injury, was hospitalized for five days and for years has affected him mentally.
“One of the key points we stressed in this trial was that this life-changing incident never had to happen. It was completely preventable and ComEd had the responsibility to complete the work at this location by properly returning the bike path to a reasonable condition for residents like Mr. Farley to use without suffering significant psychological injuries,” attorney Michael Grieco said.
The jury’s decision marks the largest monetary verdict for a McHenry County plaintiff.
