Evanston temporarily withdraws lawsuit against Fountain Square contractor

EVANSTON, Ill. (WBBM NEWSRADIO) -- There has been a major development in the city of Evanston's lawsuit against the Fountain Square contractor.

The city filed a motion to temporarily withdraw its $6 million dollar lawsuit against Copenhaver Construction for allegedly faulty fountain work at Fountain Square.

In 2022, the city sued Copenhaver for allegedly not following the manufacturer’s recommendations in its work, and claims errors caused water loss of over 4,000 gallons a day.

The fountain was shut off in 2021 as a result. The city said the motion will allow time for settlement discussions and formal mediation talks.

The motion is set for hearing on August 24.
