CHICAGO (WBBM NEWSRADIO) — Attorneys representing the family of Reginald Clay Jr. have filed a $1 million lawsuit against Chicago police and the unnamed officer who shot and killed the 24-year-old Saturday morning.

The suit — which alleges unlawful seizure, excessive force, and wrongful death — claimed Clay was talking to a group of friends in the 3800 block of West Flournoy Street before heading to a funeral when patrolling officers approached.

According to the suit, Clay ran to “avoid being hassled” and was “shot several times despite no need for use of deadly force.”

Chicago police have claimed Clay turned toward an officer while brandishing a gun before he was fatally shot.

The Civilian Office of Police Accountability (COPA) has not confirmed whether Clay pointed the gun at officers, but it did confirm that a gun was recovered from the scene.

Relatives said Clay was an innocent bystander, and that Clay was survived by his parents and a 3-year-old daughter “who must now grow up without her father.”
