Federal appeals panel won't block Illinois assault weapons ban

(WBBM NEWSRADIO) – A federal appeals panel has denied a legal attempt to halt the state’s new assault weapons ban as the measure is challenged in court.

The ruling came Tuesday from the 7th U.S. Circuit Court of Appeals in Chicago. It denied an injunction requested by a firearms store owner in Naperville as he appeals a ruling by a U.S. District Court judge who upheld the Illinois law.

Illinois banned the sale of military-style weapons and high-capacity magazines and now required owners of grandfathered weapons to register them with state police.

The law was a response to a deadly mass shooting at the Highland Park Fourth of July parade last year.

Gun store owner Robert Bevis said his business suffered because of the ban. But U.S. District Court Judge Virginia Kendall said “because assault weapons are particularly dangerous weapons … their regulation accords with history and tradition.”

Bevis’ lawsuit is one of several legal challenges the state assault weapons ban faces.
