CHICAGO (WBBM NEWSRADIO) - A Cook County judge has again sided with the parents of a Michigan woman found dead in her husband’s South Loop apartment building last month.

The latest legal battle confirms their custody of her remains.

Caitlin Tracey’s husband filed an emergency motion on Monday, trying to stop her parents from holding her funeral while he appealed a Michigan judge’s ruling giving them custody of her body.

A Cook County judge sided with her parents, the second time in less than a week. Chicago Police said 36-year-old Tracey fell 20 stories when her body was found at the bottom of a stairwell in her husband’s building last month.

The Chicago Sun-Times reported Adam Beckerink was questioned but has not been charged in connection with her death.

The paper said Beckerink, a tax attorney, was detained for filing false information on a missing persons report but has not been charged in connection with her death. Court documents said there are two active domestic violence cases against him in Michigan.

Her family plans to hold her funeral at Old St Patrick’s Church on Saturday. At 9 a.m. It will be live streamed.
