(WBBM NEWSRADIO) -- The latest in the appeals case of killer and former cop Drew Peterson includes the appointment of a special prosecutor.

Special prosecutor William Elward has agreed to investigate whether Peterson’s former lawyer Joel Brodsky violated a judge’s gag order by doing a TV interview last week, CBS 2 reports.

Peterson’s public defender said Brodsky should be held in contempt of court. Brodsky was the attorney for the 70-year old former police sergeant who was convicted in 2012 of killing his third wife.

Peterson is serving a 38-year sentence for that crime and a 40-year sentence for plotting to have the Will County’s state’s attorney killed. He seeks to have his conviction to be overturned, claiming he didn't have effective legal counsel at the time.

Special prosecutor Bill Elward is an instructor at Loyola University’s School of Law. He’s also a part-time special prosecutor with the Illinois State’s Attorney’s Appellate Prosecutor’s Office.
