A 9-year-old girl has died after she was shot in head by a robbery victim who was trying to gun down the assailant in the Houston area.
Arlene Alvarez was shot while sitting in the back seat of her family's truck Monday evening, by a man who opened fire after he was robbed at a drive-through ATM, according to the Houston Police Department.
Tony Earls, 41, told police he was with his wife at a bank ATM when an unknown male robbed them.
"Earls first shot at the robbery suspect, who was fleeing on foot, and then at a pickup truck he thought the robbery suspect had gotten into," police said in a statement.
That truck, however, was not involved in the robbery and was occupied by five members of the Alvarez family, according to police.
Arlene was rushed to the hospital in critical condition with a gunshot wound to the head. She later died.
Earls was taken into custody on a charge of aggravated assault with a deadly weapon. Additional charges could be forthcoming following Arlene's death.
The suspect accused of robbing Earls has not been identified and remains at large.
Last week, another 9-year-old girl in the area was shot in an alleged road rage incident while watching cartoons in the back seat of her family car. She's hospitalized in critical condition.
