Buffalo, NY (WBEN) As Donald Trump returns to the White House Monday, there is some wonder about what Trump will do about immigration policy. One lawyer says she expects three things to happen.
Rosanna Berardi of Berardi Immigration Law says to hear about three executive orders that he's been talking about the last week. "We are expecting a return to Title 42 which is closing the border due to health care or medical reasons. He did that during the last term, but there was COVID, so we're not sure what the basis for that's going to be," says Berardi. She also expects a remain in Mexico order to come back, meaning asylum seekers must wait outside the US, and Section 287, where the federal government deputizes local and state law enforcement officials in order to help them pursue immigration violation.
Berardi says there's also some talk of a travel ban that caught everybody by surprise during Trump's previous administration, saying certain people from certain nationalities cannot enter the United States. "That may happen as well, but there's going to be a lot of immigration chatter next week," says Berardi.
Which of these could withstand a court challenge? "Section 287 is firmly establishing the law saying that municipalities can be deputized by the federal government for immigration purposes. So we may see an expansion of that, and that one will probably hold up," says Berardi. "The title 42 and the remain in Mexico, both were controversial during the last Trump administration, so we'll have to see what the courts do with those two."
Trump served as president from 2017 to 2021. He starts his second term at noon Monday.
