Darryl Carr loses appeal over Cobblestone properties in clash with City of Buffalo

The State Court of Appeals has rejected to hear Carr's plea to keep city from taking the buildings by eminent domain

Buffalo, N.Y. (WBEN) - The City of Buffalo took a step closer to taking ownership of properties in the Cobblestone District after a long legal battle with the buildings' owner.

The State Court of Appeals on Monday has denied a motion from owner Darryl Carr to hear his case over the city taking over the property through eminent domain.

That means a lower court ruling allows Buffalo to move forward with eminent domain proceedings.

Carr claims the buildings are beyond repair, but two years ago, the city began eminent domain proceedings to take claim of the historic properties dating back to before the American Civil War.

The legal battle over whether or not to tear down 110-118 South Park Avenue has been ongoing for nearly 15 years.

After a multi-alarm fire broke out at the property last summer, Carr, once again, filed for a demolition permit to tear the buildings down, but the permit was blocked by the courts.
