Buffalo, NY (WBEN) A former Erie County Sheriff's jail deputy could lose his conditional discharge after he was arrested at Highmark Stadium last month. John Gugino is accused of refusing to leave after being ejected from a concert.

Gugino is charged with criminal trespass and harassment after prosecutors say he refused to leave a concert at Highmark Stadium after being ejected for a violation of the establishment's fan conduct policy regarding profanity. Gugino is accused of not obeying orders and struggling with deputies while being escorted out. Prosecutors add Gugino scratched a deputy's forearm and made threatening comments toward another member of the sheriff's office.


The Erie County District Attorney's Office conducted an investigation into the incident following an allegation of misconduct by members of the County Sheriff's Office. At this time, our office has found no evidence of any misconduct by law enforcement.

Erie County DA John Flynn has asked Hamburg Town Court to re-sentence Gugino on a previous drug conviction. Gugino pleaded guilty to cocaine possession earlier this year and received a 1 year conditional discharge.

Gugino, who was off-duty at the time of his arrest, was employed as a jail deputy with the Erie County Sheriff's Office. He was fired after his guilty plea.
