
BUFFALO, N.Y. (WBEN) - There are no plans to change the 10 p.m. curfew for restaurants and other businesses, despite the removal of orange and yellow zones throughout Western New York.
While restaurants can expand capacity to 50% and ten people maximum per table, restaurants must close at 10 p.m. for indoor dining. However, restaurants can operate beyond 10 p.m. for curbside and delivery services only.
The curfew was announced by the governor in November and was separate from the micro-cluster zones.
When asked about the curfew, Governor Cuomo said there are no plans to change it at this time.
"When you keep the restaurants open late, that tends to be more problematic," Cuomo said. "There tends to be more crowding. There tends to be more drinking...With restaurants, we're trying to keep it for actual eating as opposed to the restaurant turning into a bar."
Gyms and fitness centers must also close from 10 p.m. to 5 a.m. daily. That industry is allowed to increase to 33% capacity because there are no more cluster zones.
