
Grand Island, N.Y. (WBEN) - A dozen students at Grand Island High School were kept out of class for refusing to wear a mask on Tuesday.
One student who spoke to WBEN said he felt a court ruling allowed him to go without a mask.
Marcus was one of the students called to the office for not wearing a mask. "I was one of the students taken away from the education Grand Island is required to provide under the law. All we did was exercise our right, which was the right to not wear a mask," says Marcus.
A New York State Supreme Court judge in Long Island struck down Gov. Hochul's mask mandate, saying the governor nor her administration had the proper authority to do so. That was since stayed by an appellate court judge as the Hochul administration appeals.

Marcus claimed the superintendents had protested the Long Island judge's ruling by continuing to order masks.
Marcus says he was the first called down to a conference room, and then along with others, taken to the auditorium for the remainder of the day. "Until that appeal is approved, there's not pause in that ruling, and that's wrong and that's why I chose to stick up for that today," adds Marcus.

The district did not comment on the matter.
