PHOTO: Cuomo posts boating pic with dog as criminal charge looms

NEW YORK (WCBS 880) – Andrew Cuomo, who has remained elusive since resigning over the summer, posted a new photo with his dog as he wished the 4-year-old pet a happy birthday.

It’s unclear when the photo was taken, but it appears to have been since the former governor stepped down amid sexual misconduct allegations in August, as he’s sporting facial hair also seen in fishing photos he posted in late September and early October.

“Happy 4th birthday, Captain!” the former governor tweeted Sunday afternoon along with a photo of him and the shepherd, Siberian husky and malamute mix.

The photo shows Cuomo and Captain on a boat and includes superimposed cloud graphics over the two of them.

The ex-governor posted the photo as a misdemeanor charge of forcible touching continues to hang over him in connection with an accusation that he groped an aide last December.

In the latest twist in the case, the Albany County District Attorney said that the criminal complaint filed last week by the local sheriff was “potentially defective.”

Cuomo had been summoned to appear for an arraignment on Nov. 17, but Albany DA David Soares asked for that to be put off for 60 days, as did Cuomo's attorneys.

In a letter to Judge Holly Trexler on Thursday, Soares said he was caught off guard by the filing amid his office’s months-long probe. “We were in the middle of that investigation when the Sheriff unilaterally and inexplicably filed a complaint in this court,” Soares told the judge.

The court granted a delay until Jan. 7, 2022, a spokesperson for Soares said in an email.

Cuomo has repeatedly denied touching anyone inappropriately.
