Jury selection is back underway in the trial of Derek Chauvin, charged in the death of George Floyd. 9 jurors have been seated so far.
Prior to jury selection, the court heard a defense motion to get a 2019 Floyd encounter with police admitted as evidence.
Chauvin's attorney, Eric Nelson, argues It shows a modus operandi and how Floyd reacts physiologically and emotionally and encounters with police, particularly when injecting controlled substances. Prosecutor Matthew Frank said. It's prejudicial.
"The attempted reliance on habit tells us a lot about the real motivations behind this. The desperation of the defense to just smear Mr. Floyd's character by
showing that you know what he struggled with an opioid addiction, like so many Americans do."
Judge Peter Cahill, who originally suppressed the 2019 incident in the fall, is taking it under advisement and could issue a decision as soon as tomorrow, he said. It's possible some elements will be admissible, while others are not.
