SCRANTON, PA – A panel of Lackawanna County judges heard arguments Wednesday in a lawsuit challenging a special election to fill the commissioner seat vacated by former Democrat Matt McGloin. The plaintiffs are seeking an injunction to block the vote, asserting that the board of commissioners exceeded its authority in scheduling a special election.

During the proceedings, Brenda Sacco, a candidate for the appointment backed by the Lackawanna County Democratic Committee, testified. Sacco stated she would not run in a special election, explaining that her decision to pursue the appointment was based on the understanding that it would be for the remainder of the term.

The suit claims that the board of commissioners acted improperly by opting for a special election rather than making an appointment to fill the seat. The plaintiffs' legal team argued that the board's decision constitutes an overreach of its power.

The judges did not issue a ruling from the bench. The court's decision will determine whether Lackawanna County holds a special election or if the seat is filled through a different process. The outcome has significant implications for the balance of power on the three-member board of commissioners.
