10-Year-Old Canton Boy Charged With Assault For Throwing Ball At Classmate

CANTON, Mich. (WWJ) -- A 10-year-old boy is facing charges after an alleged assault on another classmate back in the spring.

Wayne County Prosecutor Kym Worthy charged the 10-year-old as a juvenile respondent for an incident that happened while playing a game at a school located in the 1270 block of Haggerty in Canton.


The prosecutor's office says on April 29, the boy was playing a game called "Tips," which uses a rubber ball similar to a dodge ball but does not involve throwing the ball at other players. During the game, the players are in a circle and everyone tosses a ball in the air and players must catch the ball while jumping off the ground, according to the prosecutor's office.

Once the game was over, the 10-year-old boy took the ball and intentionally threw it with force, causing a 9-year-old boy to suffer a concussion and abrasions to his face, according to prosecutors. The younger child's mother made a complaint to the Canton Township Police Department.

After reviewing the evidence in the case, Worthy charged the 10-year-old as a juvenile with aggravated assault, a misdemeanor charge in adult court. The prosecutor's office says in the juvenile system, "there is wide discretion in fashioning a remedy that is in the best interest of the juvenile offender."

"In many juvenile cases, we are able to craft solutions prior to charging any offense. After charging remedies can be anything from dismissal, to providing needed services for the juvenile respondent to diversion programs and beyond," Worthy said in a press release.

The 10-year-old is scheduled to appear in court on Thursday in the Lincoln Juvenile Hall of Justice.
