Judge throws out lawsuit to block certification of Wayne County election results

This is the third lawsuit attempting to challenge the election results in Michigan that has been thrown out.

(WWJ) A judge has rejected a lawsuit to stop the certification of election results in Wayne County.

Wayne County Judge Timothy Kenny rejected claims filed by the Great Lakes Justice Center claiming Republican challengers were removed from the TCF Center in Detroit during the processing of absentee ballots.

The lawsuit against Detroit and Wayne County also alleges ballots were backdated; signatures on ballot envelopes were not verified; false information was used to process ballots, including incorrect birthdates.

Election officials deny these claims.

This is the third lawsuit thrown out regarding the presidential election in Michigan.

“So basically in this particular case, the judge said that although there was some sinister activity regarding the counting of the ballots at the TCF Center, the judge found a lack of credible evidence and ruled against those people challenging the counting of the ballots,” WWJ Legal Analyst Charlie Langton said.

Langton said the claimant is likely to appeal.

“No matter how you slice it… despite numerous affidavits, the judge reviewed them all and determined there was not enough credibility for that. Bottom line, the election results in Michigan stand," Langton said.

President-Elect Joe Biden holds a 146,000-vote margin, or 2.7%, in Michigan. Thus, Biden took all of the battleground state’s 16 electoral votes.

President Trump, however, is pushing back against these results. He took to Twitter, where he falsely claimed victory in Michigan and a number of other key battlegrounds.

An earlier lawsuit, thrown out by the Michigan Court of Claims, attempted to stop the count statewide.

It alleged that someone heard someone else say that a poll worker was told by an unnamed person to change the date on at least one absentee ballot.

The judge rejected the claim, calling it “hearsay.”

The Associated Press reports Biden has 290 Electoral Votes with 50.9% of the popular vote, over 77.7 million votes.

Mr. Trump has 232 Electoral Votes and 47.4% of the popular vote, with 72.4 million votes; the highest total ever for a losing candidate.
