Gov. Whitmer signs bills making it illegal to openly carry guns at polling locations in Michigan

LANSING (WWJ) -- Openly carrying a gun at a voting precinct or ballot counting location is now illegal in Michigan.

Gov. Gretchen Whitmer says the pair of bills (House Bill 4127 and House Bill 4128), which she signed into law on Dec. 3, are "commonsense legislation" that protects voters and election workers from intimidation and gun violence.

“Together, we are creating a safe environment for voters to make their voices heard," the governor said, in a statement Tuesday.

The law does not apply to those who hold a CPL (Concealed Pistol License), which allows concealed carry of firearms, or to law enforcement and peace officers.

The bills were sponsored by state Representative Penelope Tsernoglou (D-East Lansing) and state Representative Stephanie A. Young (D-Detroit).

“Today, we are taking action to prevent voter intimidation and gun violence in our state,” said Tsernoglou, in a news release. “By increasing security measures, such as this legislation, we are ensuring that every Michigander can cast their ballot free from intimidation and that every election worker can perform their duty without fear of violence. I am thrilled to see this legislation signed into law.”

“This legislation is about protecting our democracy and everyone who makes it work. Voters, election workers and officials should never feel threatened or intimidated at the polls,” Young said. “By creating safe, weapon-free zones around polling places and counting boards, we're reinforcing the principle that violence has no place in our electoral process.”

Whitmer said the bills are part of her administration's ongoing commitment to ensuring fair and free elections.

Gun owners should also note that it remains illegal in Michigan to carry a gun at these locations. (Refer to MCL 28.425o for the complete details):

- Schools or school property (but may carry while in a vehicle on school property at dropoff or pickup by a parent or legal guardian).

- Public or private daycare center, public or private child caring agency, or public or private child placing agency.

- Sports arena or stadium.

- A tavern where the primary source of income is the sale of alcoholic liquor by the glass consumed on the premises

- Any property or facility owned or operated by a church, synagogue, mosque, temple, or other place of worship, unless the presiding official or officials allow concealed weapons.

- An entertainment facility that the individual knows or should know has a seating capacity of 2,500 or more.

- A hospital.

- A dormitory or classroom of a community college, college, or university.

- A casino
