Macomb County man convicted of manslaughter for shootout that led to wife's death, stemming from confrontation over affair

(WWJ) — A Macomb County man has been convicted of voluntary manslaughter and other charges in connection with a shootout that led to his wife’s death.

Following an eight-day trial, 46-year-old Matthew Mollicone of Washington Township was also found guilty of assault with intent to murder and three counts of felony firearm.

The charges stem from a shootout at a home in Ray Township on July 12, 2022. Authorities say Mollicone and his wife, Kimberly, had driven to the home to confront a man who allegedly had an affair with his wife.

After pulling up to the home, Mollicone entered the garage and approached the victim, pulling a gun out of his waistband, according to the Macomb County Prosecutor’s Office. The victim also reached for a gun and fired a shot over Mollicone’s head.

The two men exchanged gunfire and the other man was shot in the leg. The prosecutor’s office says he then tried to run away from Mollicone, who continued to fire shots at him.

Authorities say Mollicone returned to his vehicle with his wife. As Kimberly backed the Jeep out of the driveway, Mollicone rolled down the window and fired a shot, prompting another barrage of shots, one of which hit Kimberly in the neck, leading to her death, according to a report from The Oakland Press.

Defense attorneys argued the other man, Daniele Giannone, should have been charged with murder, according to the report.

Mollicone faces up to life in prison for the attempted murder charge, 15 years for voluntary manslaughter, and two years for the felony firearm charges. He is set to be sentenced on July 10.

Mollicone was acquitted of assault with a dangerous weapon for allegedly pointing a gun at another woman, as well as an additional count of felony firearm tied to that charge. He was also acquitted of carrying a weapon with unlawful intent, according to the Oakland Press.
