
TROY (WWJ) -- A Macomb County man with two prior drunken driving arrests is facing a new charge after an incident last week in Troy.
At 6:20 a.m. on Thursday, June 19, Troy Police responded to a call about a crash at 1000 W. Big Beaver Road, which is the Seasons 52 restaurant.
On the scene, police said officers found a 2020 Nissan Armada stopped in the mulch area of the parking lot with damage to the right and front sides of the vehicle.
When they spoke with the driver, a 42-year-old Utica man, police said they noticed his eyes were glassy and there was a strong smell of alcohol.
After he failed a series of sobriety tests, police said the man submitted to a preliminary breath test with a result of .123% BAC (blood alcohol concentration), which is well over the legal limit to drive.
The driver was arrested and taken to the Troy Police lockup where it's alleged chemical breath tests showed his BAC .122% and .120%. The driver was charged with Operating While Intoxicated (OWI) 3rd Offense and Driving While License Suspended, Revoked, Denied 2nd Offense, police said.
Under Michigan law, a third OWI conviction can lead to a prison sentence of one to five years, fines between $500 and $5,000, and a license revocation for a minimum of five years.
No injuries were reported.
The man's name was not immediately released.
