DETROIT (WWJ/AP) -- A woman who sued a Greektown bar after she said she was injured after slipping on a lemon wedge has lost her court appeal.
The Michigan Court of Appeals affirmed a lower court's decision in favor of The Old Shillelagh in downtown Detroit.
Connie Nagel said she slipped on a lemon wedge and fell in the bar on Aug. 22, 2018, injuring herself.
Nagel claimed to have seen several people slipping on spilled drinks, noting that the lemon also remained on the floor for a while after her fall. Her attorney also argued that she spoke to a bar employee, and asked to speak manager. However, no incident report was filed, and it's unclear if anyone ever told management what had happened.
An attorney for The Old Shillelagh, who said he's represented the business in other lawsuits, noted that it's a very busy bar, and that people do slip and fall there on occasion.
Court documents said Nagel failed to show that bar employees actually knew that the piece of fruit created a dangerous condition.
Nagel also "provided no evidence to show that defendant's employees caused the lemon wedge to be on the floor," the court said in its 3-0 opinion.
There's no video footage of the incident, as the business taped over it several months before the lawsuit was filed.
