Attorney: Can employers require employees to vaccinate? Not just yet

As the Delta Variant of the coronavirus spreads through unvaccinated populations, why aren't schools, employers, and others making vaccinations mandatory?

Attorney Doug Sunseri says employers cannot require people to get the vaccine at this time.


“I don’t think they can mandate it yet based on its Emergency Use Authorizations,” said Sunseri. “No entity can mandate the vaccination until final approval.”

However, Sunseri says employers can apply pressure to make it difficult for people to remain unvaccinated.

“They can put as much pressure, and put as many restrictions on the unvaccinated so that they agree to do it,” said Sunseri.

Sunseri says he believes once the FDA gives a vaccine its full approval many employers and schools will move to require all employees to be vaccinated.
