(AP) — A Louisiana appeal court says one of three men convicted in a 1998 home invasion and rape is entitled to a hearing on whether there is evidence that could clear him.
The state 4th Circuit Court of Appeal ruled in the case of Jarvis Ballard, convicted in connection with a home invasion, burglary and rape in St. Bernard Parish.
Among the issues on appeal is whether prosecutors in his 1999 trial withheld evidence favorable to his defense.
That includes statements indicating the crime was committed by only two people — both whom were linked to the attack by DNA.
Ballard's DNA was not found at the scene.
