Different deadlines for taking insurers to court over Hurricane Ida damages

Hurricane Ida is now more than one year behind us, but some people are still negotiating with insurers over the amount of their claims. There are deadlines to consider.

After Hurricane Katrina, the Louisiana legislature extended the deadline to file suit against an insurance company over a hurricane claim from one year to two, so most policyholders have until August 29, 2023. But if your insurance company is one of several that went under, and the Louisiana Insurance Guaranty Association had to assume the claim, the prescription period ends much sooner.


"The deadline to file a lawsuit for any unresolved claims is December 31st, 2022," said legal analyst Doug Sunseri.

"So there's two distinct deadlines based on whether you have a claim against LIGA, because your formerly had a bankrupt insurer, or do you have (an) insurance company in good standing," he explained.

Sunseri says once a claim settlement is agreed to, insurance companies have to pay it within 30 days, or they risk being held liable for acting in bad faith.
