Buffalo, NY (WBEN) Governor Cuomo says essential workers out of state less than 24 hours would be allowed to return to New York and not quarantine. But how effective could that rule be enforced?
Essential employees are usually firefighters, police, health care workers, and key state employees. Attorney Paul Cambria is not sure the rule is effective. "If you're worried about quarantine, it doesn't matter if they're essential or not. They could still have the virus, so it's counterintuitive," says Cambria.
He says the designation of essential employee could easily be challenged. "We're back to something that might be essential to you but someone may not agree with. It seems to me without some discreet regulations it's hard to enforce something like this," predicts Cambria. He expects a court challenge to this. "I have heard there's a challenge going on right now as to whether the governor has the authority to do this or is conducting a legislative move instead of an executive move."
