Judge rules Cantrell can proceed with emergency trash contract

A judge in New Orleans decided Wednesday afternoon to let New Orleans Mayor LaToya Cantrell proceed with awarding an emergency contract to Henry Consulting for trash pickup in the French Quarter and Downtown Development District.

The judge ruled against arguments that the emergency was invalid because the council canceled it a day after the mayor declared it.


New Orleans City Council President J.P. Morrell told WWL's Newell Normand their examination of the documents indicate the contract was not finalized until after the council's vote.

"They were arguing that the contract was completed before the council rescinded the emergency," Morrell said. "According to the city attorney, the process was Henry's signature, their signature, then the mayor's, and that contract, that is full executed, it's sent back to (Troy Henry's attorney) Daniel Daviller at 12:30 p.m. which is an hour after we needed the emergency."

Orleans Civil District Court Judge Sidney Cates' decision did not mention those arguments, but said issuing an injunction would interfere with other related litigation.
