Schools, city of New Orleans return to court over settlement dispute

Court

The city of New Orleans and New Orleans' public schools are set to return to a courtroom today in the dispute over how the city disburses tax money to the schools.

The school system wants the judge to essentially rule that the settlement they say they agreed to is now a judgment against the city.

The only problem, says legal analyst Doug Sunseri, host of All Things Legal on WWL, is that there is little that can be done if that order is ignored.

"You can't go down and seize city hall, you cannot go down and seize a city account," said legal analyst Doug Sunseri. "Their assets are not subject to seizures."

Mayor LaToya Cantrell says the settlement is invalid because she personally never agreed to it, and claims the city cannot afford it anyway -- even though she signed the budget authorizing the first payment.
