
A Texas man who allegedly shot and killed another man after he found that he was scammed out of $40 is set to be arraigned in late June, according to records from Harris County, Texas.
Click 2 Houston reported this week that 29-year-old Erick Aguirre’s bond was set at $200,000 during a Thursday court appearance. His next scheduled court date is June 27.
According to Click 2, Aguirre – who prosecutors said was already on probation for aggravated assault –was on a date April 11 and parked separately from the woman he was meeting. After they parted, they were approached by 46-year-old Elliot Nix, who allegedly claimed to be a parking attendant and asked for $40 for both cars.
Aguirre got cash from a corner store before heading to Rodeo Goat restaurant on Dallas Street, where an employee told Aguirre that Nix was scamming people, said Rick DeToto, an attorney for Aguirre’s date, per Click 2.
“Employees of EaDo Glass and Smoke then watched Aguirre sprint to his car, grab a pistol, and chase after Nix,” said the outlet. “He then allegedly fatally shot Nix and left his body on the side of Chartres Street.”
Brian Wice, a legal analyst for Click 2, said the state penal code does not “give you any legal basis to shoot and kill someone who ripped you off.”
After the shooting, Aguirre allegedly returned the firearm to his car and then met his date at the restaurant. She did not realize what had happened until Houston police released surveillance images of the couple, said her attorney.
“She knows that he was upset, and he went after the person that allegedly scammed them, but they went to have dinner, and at some point, the defendant said he was uncomfortable with the restaurant and they left,” DeToto explained. The woman was voluntarily interviewed April 13 and two days later, authorities issued a warrant for Aguirre’s arrest.
“He was arrested in the Corpus Christi area and brought back to Harris County, where he was booked into jail on Tuesday,” said Click 2. He has been charged with murder and was booked into Harris County Jail April 25.
Brent Mayr, Aguirre’s attorney, declined to comment, according to the Associated Press.
