Winner in Queens DA race to be decided in court

NEW YORK (1010 WINS) -- The New York City Board of Elections declared Queens Borough President Melinda Katz the winner in the race for Queens district attorney.

Even though a two-week-long manual recount put Katz ahead by 60 votes, public defender Tiffany Cabán has not conceded.


Cabán's team has filed a lawsuit challenging the recount because 114 paper affidavit ballots were tossed out as invalid.

Those ballots remain unopened and those votes were never counted and Cabán and her team believe those ballots could define the who the winner is.

 In a hearing set for Wednesday, the Queens Supreme Court will now decide who the Queens DA will be."While it is everyone's right to avail themselves of the judicial process, I urge all participants in this hard-fought election to come together and join me in beginning the hard work of reforming the criminal justice system in Queens," Katz said in a press release. "This is a major moment for this borough, and it will take the support of all its residents to make this effort a success. I will be spending the months ahead preparing for this critical task."

The primary winner is expected to win the general election in November.
