
NEW YORK (1010 WINS) — A Queens man who was extradited from Florida months after he violently murdered his brother during a fight in 2022 was sentenced Wednesday to 25 years to life in prison, Queens District Attorney Melinda Katz announced.
Henrry Gutierrez, 32, was found guilty of second-degree murder and criminal possession of a weapon following a jury trial that began in February, prosecutors said.
The fatal stabbing occurred on the evening of July 12, 2022, in the multi-family home on Jamaica Avenue where both Henrry Gutierrez and his brother, 52-year-old Oscar Gutierrez, lived.
Henrry Gutierrez resided on the third floor of the home, and at about 6:20 p.m. descended to the second-floor apartment occupied by Oscar Gutierrez, Henrry Gutierrez’s ex-girlfriend and her son.
Upon entry prosecutors said that he grabbed a hammer, retrieved a knife from a kitchen drawer and called on his brother to come out of his room.
When the victim came out to meet him, Henrry Gutierrez began waving the hammer around, which prompted Oscar Gutierrez to swing a broom handle at him. Henry Gutierrez responded by stabbing his brother 14 times with the kitchen knife, all about the body, prosecutors said.
Family members at home called the police, but Henrry Gutierrez fled the scene, leaving the murder weapon, hammer and broom all at the scene. He was apprehended in Volusia County, Florida, months later and extradited.
“This is an extraordinary family tragedy,” Katz said. “One brother is dead, and another will spend 25 years to life behind bars for his gruesome killing.”
