Mistrial declared during former Upstate deputy's trial

A mistrial has been declared after surprise evidence was introduced in the trial of a former Upstate deputy. Ryan Gibson, a former Greenville County Deputy has been in court this week on charges of 3rd degree assault and misconduct in office.

The charges stem from an incident during a traffic stop in 2020. SLED charged Gibson after an investigation into claims that he used excessive force. A man named Benny Jones says, he stopped to witness a traffic stop involving an acquaintance and Deputy Gibson. Jones claims that Gibson kicked and hit him during the exchange.


Officials say, Gibson does have two prior incidents in which he's accused of using excessive force. The trial started Wednesday, but a mistrial was declared on day two, after Gibson's attorney introduced surprise evidence. The defense produced body cam footage that had not yet been previously introduced, the judge cited that as " a clear violation of the rules".
