South Carolina is joining 21 other states in a lawsuit against the Biden Administration. State Attorney General Alan Wilson says, the legal fight is based on new guidance regarding gender discrimination for schools and programs that receive federal nutrition assistance.

In May, the USDA's Food and Nutrition Service issued guidance to South Carolina and other states, stating that discrimination based on gender identity and sexual orientation would impact funding for school food programs.

The lawsuit claims the USDA's guidance is unlawful based on several factors. Wilson said " I'm not going to stand by and let the Biden administration hold school lunches hostage over radical ideology."
