Three men are facing simple assault charges but protestors and some political leaders are asking for aggravated assault charges.

Zappala has said he is sticking to the lesser simple assault charges saying that aggravated assault would be on par with third-degree murder.

The two women involved in the incident are expected to hold a news conference Friday.
