The battle over masks continues in the North Allegheny School District. Three families are suing the North Allegheny School District over its optional mask policy.
The families claim the district's optional mask policy violates the Americans with Disabilities Act by forcing parents of medically-fragile children to either pull their children out of in-person learning, or send them to school where there is an increased risk of exposure to COVID-19.
Their attorney, Ken Behrend, is a North Allegheny parent himself.
"To isolate or quarantine someone because they're disabled is discrimination on its face and it's just wrong to treat people in different ways that way. It's not who we are as a country."
A district spokesperson says they do not comment on pending litigation. The lawsuit claims as many as 1,500 students in the district are considered medically-fragile.
The North Allegheny School Board narrowly voted in December of 2021 to allow parents to decide if their children should wear masks.
