A Westmoreland County bar is being sued by a woman who says she's a quadriplegic because she was served too much alcohol and fell off a stool.
Mary Jo Jordan says her injuries two years ago were caused by staff negligence at the Lone Star Inn in Bell Township.
Jordan's suit contends she was continuously served vodka and beer despite being visibly intoxicated.
She's seeking unspecified damages for pain and suffering and loss of future earnings.
Attorney John Perry discussed the case on the Big K Morning Show Friday.
"A lawyer who sees somebody who's a paraplegic with huge damages looks at this case and says well hey they had a duty not to serve somebody visibly intoxicated what is left out of the analysis is what's called contributory negligence,"
In Pennsylvania, if a person's negligence is greater than 50 percent, you're not allowed to make a recovery.
"The bar owner will probably be found somewhat responsible, but unfortunately the injured person in this case is going to be determined to be greater than 50 percent responsible and there won't be a recovery," said Perry.
