Fetterman files lawsuit over mail-in ballots

John Fetterman's campaign has filed a federal lawsuit over mail-in ballots that will not be counted.

State law requires a date on the envelope. The state Supreme Court ruled last week undated and wrongly dated mail-in ballots will not be counted. Fetterman's suit contends the date is a technicality.

GOP attorney John King explained on the Big K Morning Show, “They filed the suit to make the counties count what we consider to be the illegal ballot, the undated, the improperly dated. Pennsylvania is widely criticized for how long it takes to count votes and when you add in lawsuits like these by Fetterman and by the democrats, it’s just going to delay things potentially.”

King says the Republican party will file to intervene in the federal suit. State law requires voters to write a date on the outer envelope.

County Executive Rich Fitzgerald recollects, “We had this in 2020 when the Trump people went to court twenty some times over different voting challenges that they would make, so it’s part of the process.”

The Pennsylvania Supreme Court ruled last week undated and incorrectly dated ballots will not be counted.

Fetterman's campaign is suing because thousands of undated ballots will be set aside in Pennsylvania.

About 80 percent of mail-in ballots are cast by Democrats.
Fetterman stands to lose votes in a tight race with Republican Mehmet Oz.
