LA Councilman Joe Buscaino wants the city to sue the school district to get kids back on campus.

LA Unified leaders call it a "political stunt."

KNX 1070 has reached out to the City Attorney and the Mayor's office for comment. Nothing yet.

Buscaino argues if private schools can reopen, with waivers, public schools should also let students return.

Superintendent Austin Beutner and the members of the Board of Education say in a statement schools are ready to reopen but COVID-19 levels in LA remain too high. And they insist: "We cannot break state law to reopen schools."

"I'm listening to the pediatricians, the director of the CDC, Dr. Fauci who are all saying our schools should reopen," Buscaino says.

San Francisco is suing its school district to try to force schools to reopen.

He has two sisters who teach in the district.

"They want to get back to the classroom," he says.

Buscaino will be asking his fellow council members to join him in directing LA's city attorney to follow suit. But does he have enough support?

"That's to be seen," he says.

Buscaino plans to introduce the motion next week.
