A Las Vegas man claimed police charged him with driving under the influence after accusing the man of having an "open container" in his car. The man, however, said the drink from Chipotle contained no alcohol.

TikTok user @shamansaucy said he had only had the restaurant's Hibiscus Lemonade that day in a post on August 8.

"This is how I got my first DUI," the man wrote on TikTok, showcasing the alleged beverage. "He said my 'open container' tested positive for alcohol."

The "kinda fruity, kinda lemon-y" drink -- made with hibiscus, lemon, and turmeric -- is advertised as a non-alcoholic mix featuring "tart hibiscus flower and fresh citrus."

The man's claims in the video have not been verified.

"We take these allegations very seriously and have asked the guest to contact us with additional details," Laurie Schalow, Chipotle's food safety officer, told Newsweek. Additionally, our beverage vendor has provided a statement outlining the unlikelihood of this occurrence."

TikTok users supposed the DUI could be "because the tea is fermented." A former fast-food restaurant employee said they'd seen similar cases of alcoholic fermentation.

"Given that sugary fruit juice will ferment in warm, conducive environments—though the rates of fermentation vary wildly—the theory is not entirely implausible," Newsweek reported.

Not everyone who watched the video was convinced.

"I work there, I fill them up actually since I'm the cashier," commented one user. "There's NO WAY, it's literally concentrate and WATER!!"
