SAN FRANCISCO (KCBS RADIO) – The Napa County District Attorney on Thursday filed charges against Paul Pelosi following his DUI arrest in late May.
Pelosi – husband of House Speaker Nancy Pelosi – has been charged with driving under the influence of alcohol causing injury and driving with a 0.08% blood alcohol level or higher causing injury. Both charges were filed as misdemeanors "based upon the extent of the injuries suffered by the victim," officials said in a news release.
He faces up to five years of probation and a minimum of five days in jail.
Pelosi could also be punished with the installation of an ignition interlock device, fines and fees, completion of a court ordered drinking driver class and "other terms as appropriate."
His official blood alcohol level was 0.082% at the time of the crash on May 28. Authorities said it happened at about 10:17 p.m. at State Route 29 and Oakville Cross Road just north of Yountville. Both vehicles "sustained major collision damage" after Pelosi's Porsche hit the victim's SUV.

Neither received medical treatment at the scene, officials added.
When asked for his identification, Pelosi, 82, "handed officers his driver's license and an '11-99 Foundation' card." That's when responding California Highway Patrol officers "observed objective signs and symptoms of alcohol intoxification" coming from Pelosi.
He was asked to perform field sobriety tests just before his arrest.
The victim, who is declining to be identified as part of the media release, was interviewed by investigators on June 2. At the time, he reported arm, shoulder and neck pain, along with headaches.
Following much scrutiny, Pelosi's booking photo was released on June 13.
Pelosi is due in Napa County court for an arraignment on Aug. 3.
