Death Sentence Overturned For Kaufman County Mass Murderer

DALLAS (1080 KRLD) - The Texas Court of Criminal Appeals has done a reversal on a mass murder case out of Kaufman County.

The death sentence for Charles Brownlow of Kaufman has been overturned and sent back for a re-hearing.

It was just before Halloween, 2013 that Charles Brownlow setout on a murderous rampage. After getting into an argument with his mother over a cell phone, Brownlow first killed her.

Brownlow then went to his aunt's house, murdered her, went to the home of two friends, murdered them and then went to a gas station where he killed attendant Luis Carillo.

It was five murders in all.

Brownlow was convicted of murder and sentenced to death for Carillo's case.

But in a ruling today the high court says there has been new guidance on intellectual disabilities and how they factor into a death sentence.

The court overturned the death sentence and sent the case back for another penalty hearing, which effectively is another trial with all the evidence, just for punishment. Only this time the jury will also consider Brownlow's mental state.

Either way Brownlow won't be getting out of prison.

If the new jury does not sentence Brownlow to death the alternative is life without parole.
