Pagourtzis' capital murder trial was supposed to start early next year and had been moved from Galveston to Fort Bend County.
Orwig says there's a big disconnect between being incompetent to stand trial and pleading insanity.
Insanity has to do with the suspect's state of mind at the time of the crime, "or did the defendant have the ability to form the requisite criminal intent. Competence to stand trial is what the defendant's state of mind right now and is he able to assist his counsel in preparing for a defense." Pagourtzis was 17 at the time of the shootings so he will not be eligible for the death penalty.
