A security guard working as a contractor for XTC Cabaret was shot Sunday morning a few hundred feet from the club on North Stemmons Freeway near Empire Central. Dallas Police were called to a parking lot at 1311 Empire Central at 6:08 a.m. Sunday.

Dallas Police say a security guard had returned to his car and had left the club. They say a witness saw a second car pull up, and someone inside started shooting. Police say the security guard and the other person exchanged gunfire.

Police say both security guards left the club in separate cars. In the 1300 block of Empire Central, they say the same group pulled next to the guard who responded and fired into his car. The person was shot in the head, but police say he was treated and released from the hospital.

XTC Cabaret wrote in a statement, "the incident in question occurred approximately two miles away when the security guard was in his car driving home."

The address provided by Dallas Police on Empire Central is 500 feet from XTC Cabaret.

"We are thankful the security guard is okay and at home recovering," a spokesman for XTC Cabaret, Gary Fishman, wrote in a statement.

Monday afternoon, police had not arrested a suspect.

In March 2021, a 32 year old man was shot and killed in the parking lot of XTC Cabaret.

In 2019, a 34 year old man was shot and killed by security guards outside the business after a fight inside. Both guards were charged with murder; both were no-billed by grand juries.

In January, the Dallas City Council unanimously passed a measure requiring sexually oriented businesses to close from 2 to 6 a.m. after a request from police trying to curb violence at the businesses.

"This is about public safety," Mayor Eric Johnson said during discussion about the proposal in January. "It's not about shaming anyone's career choices.

An organization representing club owners sued to block the ordinance, and the City of Dallas has not enforced the rule during the legal challenge.
