
The State's highest criminal court agrees to hear a Dallas case that involves the death of a child.
The Texas Court of Criminal Appeals wants to hear more about what 32-year-old Sedrick Johnson told police who were investigating the disappearance of an 18-month-old child whom Johnson was supposed to be watching.
The body of Cederick Jackson was later found in a landfill.
Police say Johnson told them he had swaddled the child tightly in a blanket as a restraint because the toddler was making a mess out of ketchup packets. An affidavit says after a while the child began to show signs of distress and passed out, then became unresponsive, and that Johnson tried to give CPR.
Police say Johnson eventually gave up and threw the child into a trash dumpster.
Defense lawyers say those statements were made before Johnson had a lawyer present. A judge and an appeals court have sided with the defense.
No date for arguments before the Court of Criminal Appeals has been set.
